On March 24, 2021, the Zambian parliament enacted the Cyber Security and Cyber Crimes Act which went into effect on April 1, 2021. The law creates protections for individuals against cyber crime, addresses child safety online, and imposes new telecommunications surveillance requirements. In addition, the law established the the Zambia Computer Incidence Response Team and the National Cyber Security Advisory and Coordinating Council. The law bans use of a computer to disseminate hate speech with fines of up to 150,000 kwacha ($7,100) and two years imprisonment. Critics of the law believe it goes too far by restricting speech “tending to corrupt morals” which carries a fine of up to 3,000 kwacha ($140). Under the law, the Zambian government requires telecommunications companies to collect the full names and addresses of its users. The government can also compel such companies by court orders and warrants to intercept data, turn over stored communications, and install monitoring systems.
