A French mayor, Julien Sanchez, is seeking review of the Sanchez v. France decision in the European Court of Human Rights’ Grand Chamber which extended online intermediary liability rules to social media users. Last year, its lower chamber found that there was no violation of freedom of expression when Sanchez was found criminally liable for failing to promptly remove hateful comments written on his Facebook wall by third parties. On April 8, 2022, The Electronic Frontier Foundation and Media Defence submitted an amicus brief to the Grand Chamber, asking it to reconsider and reject imposing liability on a social media user for third party content.
