On April 23, the European Parliament and EU Member States agreed on a final draft of the Digital Services Act (“DSA”), proposed by the European Commission in December 2020. Building on the eCommerce Directive from 2000, the DSA overhauls how EU law will treat intermediary liability for online service providers and introduces a new set of obligations applicable to these actors. The agreement is now subject to formal approval by the European Parliament and Council. Once adopted, the DSA will apply across the EU the later of fifteen months thereafter or January 1, 2024 (except for large platforms for which it will apply four months after designation).
